These Terms of Use ("Terms") govern your access to and use of websites and online services operated by or on behalf of Kellan Restaurant Management and its affiliated restaurant brands and entities, including 54th Street Restaurant & Drafthouse, 54th Street Scratch Grill & Bar, and Five Four Restaurant & Drafthouse (collectively, "54th Street," "Five Four," "we," "us," or "our").
By accessing or using our websites, you agree to these Terms. If you do not agree, please do not use the websites. Additional terms may apply to specific services, programs, promotions, purchases, or transactions.
2. Privacy
Our collection and use of personal information is described in our Privacy Policy. Our websites may also provide a "Your Privacy Choices" tool for managing certain cookie, advertising, or privacy preferences.

Nothing in these Terms grants you a license or right to use our trademarks, copyrighted materials, or other intellectual property except for ordinary personal use of the websites.
5. Menus, Pricing, Nutrition, and Restaurant Information
We try to keep menu descriptions, pricing, hours, availability, promotions, restaurant information, and other website content accurate and current. However, information may vary by location, change without notice, or contain errors.
Prices, menu items, ingredients, availability, promotional offers, hours, and other restaurant details shown online are subject to change and may differ by restaurant. For dietary, allergen, or ingredient concerns, please contact the restaurant directly and review any applicable allergen or nutrition information before ordering.
6. Online Ordering, Gift Cards, Loyalty, and Other Services
Our websites may provide access to online ordering, gift cards, loyalty programs, waitlist functionality, employment opportunities, virtual tours, maps, and other services. Some services are operated by third-party providers and may be subject to additional terms and privacy policies.
Five Four Rewards, gift cards, promotions, contests, online orders, and other programs or transactions may be governed by separate terms, rules, eligibility requirements, expiration provisions, or restrictions. If separate terms conflict with these Terms regarding a specific service or program, the more specific terms will control for that service or program.
7. Third-Party Websites and Services
Our websites may contain links to, embedded content from, or integrations with third-party websites and services. We provide these features for convenience and do not control all third-party content, systems, availability, security, or privacy practices.

9. SMS/Text Messaging Terms
SMS Enrollment. Subscribers may opt in to receive SMS/text messages from 54th Street Restaurants and/or Five Four Rewards as part of the loyalty registration process at [PAYTRONIX ENROLLMENT LINK]. By opting in, you agree to receive automated promotional and personalized marketing text messages at the mobile phone number you provide.
Message Content and Frequency. Messages may include information about promotional programs, loyalty rewards, offers, new menu items, and other marketing communications. Messages for this program will be sent from [SMS NUMBER] and will identify the applicable 54th Street/Five Four loyalty program. Consent to receive automated marketing messages is not a condition of any purchase. Message frequency varies. Message and data rates may apply.
Opt-Out. To stop receiving SMS/text messages, text STOP to [SMS NUMBER]. After texting STOP, you may receive one additional message confirming that your opt-out request has been processed.

Mobile carriers are not liable for delayed or undelivered messages. Your participation in the SMS program is also subject to our Privacy Policy and any additional disclosures presented at the time you enroll.
10. Promotions
Sweepstakes, contests, coupons, rewards, limited-time offers, and other promotions may be governed by separate official rules or offer terms. Eligibility, participating locations, redemption restrictions, expiration dates, and other conditions may apply.
11. Employment Opportunities
Our websites may link to a third-party employment or applicant-tracking service. Job postings are subject to change or removal at any time. Submission of an application does not create an employment relationship or guarantee an interview or employment.
12. Website Availability and Changes

TO THE FULLEST EXTENT PERMITTED BY LAW, KELLAN RESTAURANT MANAGEMENT, ITS AFFILIATES, RESTAURANT BRANDS, AND THEIR RESPECTIVE OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE WEBSITES.
NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
15. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Kellan Restaurant Management, its affiliates, restaurant brands, and their respective owners, officers, directors, employees, and agents from claims, liabilities, damages, losses, and expenses arising from your unlawful misuse of the websites, your violation of these Terms, or your infringement of another person's rights.
16. Governing Law and Venue
These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles, except where applicable law requires otherwise. Any dispute that is not subject to another binding agreement or legally required forum will be brought in an appropriate state or federal court located in Missouri, subject to applicable jurisdiction and venue requirements.
17. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date above. Your continued use of the websites after updated Terms become effective constitutes acceptance to the extent permitted by law.
18. Severability and Waiver
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law. Our failure to enforce a provision of these Terms is not a waiver of that provision or any other right.
